Terms of Service
These Terms of Service (“Terms”) govern your use of the Super Dispatching driver mobile application and the carrier dashboard (together, the “Services”), provided by Super Dispatching, Inc. (“Super Dispatching,” “we,” “us”). By using the Services you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
The driver app is intended for professional drivers who have been authorized by a motor carrier that holds an account with us. You may not create a driver account yourself: the carrier adds you to its roster and issues your credentials. You must be at least 18 years old and legally permitted to perform the transport work you record in the app.
2. Accounts and credentials
Your carrier owns and controls your driver account, decides whether app access is enabled, and can issue, change, or withdraw your password at any time. Keep your credentials confidential and do not let anyone else use your account. Tell your carrier and us promptly if you believe your account has been used without your permission.
3. Your carrier's role
We provide the software; your carrier operates its own dispatch. Load assignments, schedules, pay, and employment matters are between you and your carrier. Where we process data on a carrier's behalf, the carrier is the controller of that data and its own policies also apply to you.
4. Acceptable use
You agree not to:
- submit information you know to be false, including inspection results, photographs, signatures, or delivery confirmations;
- use the Services for any unlawful purpose, or in a way that violates transport, safety, or privacy law;
- attempt to gain access to accounts, loads, or data that are not yours, or to probe, scan, or interfere with our systems;
- copy, reverse engineer, resell, or build a competing service from the Services or their content;
- operate the app while driving. Complete inspections, photographs, and status updates only when your vehicle is safely stopped.
5. Content you submit
You keep ownership of the photographs, signatures, notes, and documents you submit. By submitting them you grant us the rights needed to host, process, transmit, and display that content in order to operate the Services, and you grant your carrier access to it as the record of the work performed. You confirm you have the right to submit what you upload, including any photographs that show other people or property.
6. Location and device permissions
The app asks for camera access to scan VIN barcodes and capture inspection photographs, and for location access to record where an inspection was performed. Location is optional and you may decline or revoke it in your device settings; the app continues to work without it. The app does not record audio. How we handle this data is described in our Privacy Policy.
7. Business records
Bills of lading, vehicle inspection reports, and the photographs and signatures collected on them are business and transport records of the carrier. They are retained after a driver stops using the app, including after account deletion, because carriers may be required to keep them for legal, insurance, and accounting purposes.
8. Deleting your account
You may delete your driver account at any time from Settings → Account → Delete Account in the app, or through the deletion request form. Deletion permanently revokes your access, invalidates your password, signs you out of every device, and erases your stored signature and profile edits. It cannot be undone from the app; regaining access requires your carrier to issue you a new password. The business records described in section 7 are not deleted.
9. Availability and changes
We may change, suspend, or discontinue any part of the Services, and we may update the app to keep it working with current mobile platforms. We aim for continuous availability but do not guarantee it: the Services can be interrupted by maintenance, network conditions, or events outside our control.
10. Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that any data you submit will always be available. Nothing in the Services is legal, safety, or compliance advice, and using the app does not relieve you or your carrier of any regulatory obligation.
11. Limitation of liability
To the maximum extent permitted by law, Super Dispatching is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost or corrupted data, arising out of or relating to your use of the Services. Our total liability for all claims relating to the Services will not exceed the amount your carrier paid us for the Services in the twelve months before the event giving rise to the claim, or one hundred US dollars if no amount was paid. Some jurisdictions do not allow certain of these limitations, in which case they apply to you only to the extent permitted.
12. Termination
Your carrier may end your access to the app at any time. We may suspend or end access if these Terms are breached, if access is required to be withdrawn by law, or if the carrier's account with us ends. Sections 5, 7, 10, 11, and 13 survive termination.
13. Changes to these Terms
We may update these Terms. When we do, we will change the “Last updated” date above and, for material changes, give notice through the Services. Continuing to use the Services after an update means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the United States and of the state in which Super Dispatching, Inc. is organized, without regard to conflict-of-laws rules, except where the law of your place of residence requires otherwise.
